  • Cheating and Plagiarism: Engaging in dishonest practices, including cheating on assessments or submitting plagiarized work, is strictly prohibited and may result in account suspension or termination.
  • Unauthorized Access: Attempting to gain unauthorized access to restricted areas of the LMS or using another user’s credentials is a violation of these Terms and Conditions.

3.5 Technical Requirements

  • Device Compatibility: Users are responsible for ensuring that their devices meet the technical requirements to access and use the LMS effectively. Minimum system specifications will be outlined during registration.
  • Internet Connectivity: A stable internet connection is required to access the LMS. The Academy is not responsible for interruptions caused by poor connectivity or user-side technical issues.

4. Payment & Fees

4.1 Pricing Information

The fees for courses available on the Audrey Gwangwa Law Academy LMS are clearly listed on each course page. Prices are subject to change, but any changes will be communicated in advance. The price at the time of your enrollment will remain fixed for the duration of your course access.

4.2 Payment Methods

We offer various secure payment methods for your convenience. Accepted payment methods include:

All payments must be processed before you can access any paid content or courses.

4.3 Course Enrollment

4.5 Payment Confirmation and Access

Upon successful payment, you will receive an email confirmation, and your account will be credited with access to the enrolled course(s). In the case of bank transfers, please allow up to 48 hours for the payment to be processed and confirmed.

4.6 Taxes

All course fees are inclusive of applicable taxes unless otherwise specified. If additional taxes are required in your jurisdiction, these will be calculated and displayed during the checkout process.

4.7 Late Payments

If your payment is not received within the specified timeframe, your course access will be suspended until the payment is processed. Late payment may result in a delay in the activation of your course access.

4.8 Price Changes

While we strive to keep our pricing transparent, Audrey Gwangwa Law Academy reserves the right to adjust course fees as necessary. Any changes to pricing will not affect your existing enrollments, and you will not be charged for future courses at the new rate unless stated otherwise.

5. User Conduct

At Audrey Gwangwa Law Academy, we are committed to maintaining a professional, respectful, and collaborative learning environment. By accessing and using the LMS, you agree to adhere to the following conduct guidelines:

5.1. Respectful Behavior

You are expected to engage respectfully with fellow learners, instructors, and the academy’s staff. Discriminatory, offensive, or harassing behavior will not be tolerated. 5.2. Academic Integrity

6. Intellectual Property

However, by submitting content, you grant Audrey Gwangwa Law Academy a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute the content for the purpose of operating and promoting the LMS.

8. Termination of Access

Audrey Gwangwa Law Academy reserves the right to suspend or terminate a user's access to the Learning Management System (LMS) under certain circumstances. Access may be terminated for various reasons, including but not limited to:

8.1 Account Suspension or Termination

  • Violation of Terms: If you violate any of these Terms and Conditions, including engaging in unlawful, disruptive, or abusive behavior, your account may be suspended or permanently terminated without notice.
  • Fraudulent Activity: Any suspected fraudulent activity, such as providing false information or attempting to manipulate the system, will result in immediate suspension or termination of your access.
  • Intellectual Property Infringement: Unauthorized copying, distribution, or sharing of course materials or other protected content will lead to account suspension and potential legal action.

8.2 User-Initiated Termination

Cancellation will stop further charges, but you will retain access to the courses you have already paid for until the end of the current billing period or course duration.

User success is dependent on individual effort, circumstances, and external factors beyond our control.

Limitation of Liability

To the fullest extent permitted by law, Audrey Gwangwa Law Academy, its directors, employees, agents, or affiliates will not be held liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or other damages arising from:

  • Your use or inability to use the LMS.
  • Any content or services obtained through the LMS.
  • Any errors, interruptions, or defects in the LMS or related services.
  • Any unauthorized access to your account or data.

In no event shall Audrey Gwangwa Law Academy’s total liability to you exceed the amount you have paid for the course or service in question, whichever is less.

Indemnity

You agree to indemnify, defend, and hold harmless Audrey Gwangwa Law Academy, its directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from:

These Terms and Conditions, and any disputes arising from or related to your use of the Audrey Gwangwa Law Academy Learning Management System (LMS), will be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.

Dispute Resolution

In the event of a dispute or disagreement arising from your use of the LMS, we are committed to resolving it in a fair and amicable manner. We encourage you to first contact us directly at info@audreyacademy.co.za to attempt to resolve any issues.

  • Negotiation: Both parties will make reasonable efforts to resolve the dispute through informal negotiation or discussion within a reasonable period.
  • Mediation: If the dispute cannot be resolved through negotiation, either party may request mediation. The mediator will be chosen by mutual agreement between the parties, and the mediation will take place in Centurion, South Africa.
  • Arbitration: If mediation fails, the dispute shall be submitted to binding arbitration under the Arbitration Foundation of Southern Africa (AFSA) rules. The arbitration shall take place in Centurion, South Africa, and the decision of the arbitrator will be final and binding.
  • Court Jurisdiction: In the event that a dispute is not resolved through the processes outlined above, either party may submit the matter to the competent courts in South Africa. Both parties agree to submit to the exclusive jurisdiction of the courts of South Africa.

By agreeing to these Terms and Conditions, you acknowledge and consent to the jurisdiction of the South African courts and the arbitration process outlined above for resolving any disputes.

Audrey Gwangwa Law Academy reserves the right to update, modify, or change these Terms and Conditions at any time, without prior notice. Any changes will be effective immediately upon posting on the Learning Management System (LMS) or notification to you via email or through the LMS platform.

If you do not agree with the revised Terms and Conditions, you should discontinue use of the LMS and may cancel your account as outlined in our account termination policy.
